Repeal of Windfall Elimination Provision (WEP) and Government Pension Offset (GPO):
WEP:
This provision, enacted in 1983, reduces Social Security benefits for retirees who receive pensions from jobs not covered by Social Security, such as certain public sector positions. The Act eliminates this reduction, ensuring that public servants who worked in both Social Security-covered and non-covered roles receive their full Social Security benefits based on their earnings.
GPO:
Similarly, the GPO, established in 1977, reduces spousal or widow(er) benefits for those receiving a government pension. The new law abolishes this offset, restoring full benefits to spouses and survivors of public sector workers.
Beneficiaries:
The Act primarily benefits approximately 3 million individuals, including teachers, firefighters, police officers, and other public service employees who have pensions from non-Social Security covered employment. This includes federal, state, and local government employees who have also worked in Social Security-covered jobs at some point in their careers.
Effective Date and Retroactivity:
Changes to benefits are effective for payments made after December 2023, with the Social Security Administration tasked with adjusting primary insurance amounts accordingly. There will be back-dated payments to cover any benefits that were withheld due to WEP or GPO since January 2024.
